The Supreme Court was hearing the appeal of seven accused who were convicted by the trial court and then by the Patna High Court in the case of kidnapping and murder of a woman in a property dispute. The court acquitted all seven men on the ground that the prosecution's story was highly shaky.

One of the issues raised by the court was whether the woman lived in the property where the incident took place.
It found that witnesses related to the deceased had testified that she was living in the house at the time of the incident. During investigation, the police found makeup items and also found that another woman was living in the same part of the house.
The Patna High Court took note of this fact, but also said that the makeup items could not belong to the woman as she was a widow. She had no need to wear makeup.
Objecting to this, the bench of Justice Bela M. Trivedi and Justice Satish Chandra Sharma said:
In our opinion the observation of the High Court is not only legally untenable but also highly objectionable. Such a sweeping observation is inconsistent with the sensitivity and neutrality expected from a court of law, Especially when it is not supported by any evidence on record."
