Petition filed against illegal demolition by Gujarat authorities in violation of Supreme Court order.
A petition has been filed challenging the illegal demolition carried out by Gujarat authorities in violation of the Supreme Court order. The Gujarat government has violated the Supreme Court order in the matter of demolition of Muslim religious and residential places on September 15.
Case Title: Sammast Patni Muslim Jamaat v. State of Gujarat & Ors. Jamiat Ulama-i-Hind v. North Delhi Municipal Corporation, Writ Petition (Civil) No. 295/2022
The matter is listed before a bench of Justices BR Gavai and KV Vishwanathan.
Another contempt petition was filed before the Court after 47 residents of Assam approached the Supreme Court against the alleged illegal demolition in violation of the Supreme Court order in the bulldozer case.
In which Gujarat authorities were accused of illegally demolishing Muslim religious and residential places on September 28 without issuing notice and/or providing an opportunity to be heard.
The petition was filed by Summast Patni Muslim Jamaat, a trust representing the Patni Muslim community of Prabhas Patan.
It said ,
"The respondents on 28.09.2024 without issuing any notice and without affording an opportunity of being heard,Centuries-old Muslim religious places of worship, including mosques, Eidgahs, dargahs, tombs and residential places of the mutawallis of the said dargahs were illegally demolished in the early morning hours."
The petitioner claims that the authorities in Gujarat violated the September 17 order by carrying out demolition without any prior notice.
The petition sought initiation of contempt proceedings. The Chief Secretary of Gujarat State, Collector and District Magistrate, SP (Gir Somnath) and others were impleaded as party-respondents.
